We also offer a sack collection service if you are unable to accommodate a bin on your premises. Sacks are charged on a pay-as-you-go basis.
What is it?
Every business has a legal requirement to ensure the safe collection and disposal of that it produces. To comply with section 34 of the Environmental Protection Act 1990 businesses must take steps to:
- Prevent harmful treatment or deposits of waste
- Prevent escape of waste from its control
- Ensure any person or company you transfer waste to has appropriate authorisation to carry and dispose of waste
- Provide accurate descriptions of any waste that is transferred
How can we help?
As part of our service to you, Wyre Forest Business Waste can provide you with an annual Waste Transfer Note. This document ticks all the legal boxes and ensures you fulfil your Duty of Care.
- You need to keep the Waste Transfer Note for a minimum of two years
- Make sure you check all information is correct before you sign it
- Be prepared to produce your Waste Transfer Note ready for an inspection
Failing to meet Duty of Care requirements is a criminal office and you could be prosecuted.
What am I not allowed to do?
As a business, you cannot do the following:
- Take commercial waste home and dispose of it as domestic waste
- Take commercial waste to a household waste disposal site
- Allow an unauthorised person to collect your waste without providing a Waste Transfer Note

On 31 March 2025, the Department for Environment, Food and Rural Affairs (DEFRA), is making changes to the way businesses in England dispose of their waste and recycling. This new legislation is called Simpler Recycling.

What is changing?
Businesses will no longer be allowed to use their general waste bin to dispose of all of their waste.
DEFRA expect you to separate out paper, card, plastic bottles, tubs, trays, cartons, metal tins, cans, foil, empty aerosols and glass. This is known as dry mixed recycling (DMR).
If you already have or need recycling collections, we have an exemption that allows us to continue collecting DMR in a single bin.
You do not need multiple recycling bins if we collect your recycling waste.
DEFRA also expect you to separate out food waste. This could be leftover lunches, tea bags, fruit or vegetable peelings or coffee grindings.
We now offer a food waste collection service and you will need a separate bin for this.
Do the changes apply to me?
The new legislation applies to all workplaces in England, profit or non-profit, including care homes, educational establishments, charities, healthcare establishments and places of worship.
The changes apply to any business with 10 or more full-time employees from 31 March 2025.
The changes apply to any business with less than 10 full-time employees from 31 March 2027.
If you have multiple branches, you will need to count the total number of employees across your enterprise and have a food bin at each branch. Volunteers are not included as determining the number of full-time employees you may have.
What happens if I don’t recycle correctly?
The Environment Agency can issue a compliance notice against anyone that is not compliant with the requirements. It is an offence to fail to comply and you may be liable to pay a fine.
What if I don’t produce much food waste?
You will need to arrange for food waste collections regardless of the amount of volume of food waste that you produce.
How should I dispose of my food waste?
We can supply you with a food waste bin, or more if you need them. Food waste must be in a tied plastic bag before it is put in your food waste bin.
I compost food waste, is this still allowed?
You can still compost food waste, however any additional food waste that you produce must be collected separately.
Can I share a food bin with other businesses near me?
You are allowed to share food bins with other businesses. If you wish to share a food waste bin, you will need to arrange and agree this. You will need to nominate a lead business to hold the contract with us and we will deal solely with this business in relation to food waste. You will need to notify us of any food bin sharing agreements.
Is there any funding to help me meet the requirements?
Unfortunately, DEFRA has not provided any funding to help businesses meet the new requirements.
Do I need to pay for a food or recycling collection service?
Yes, both food waste and recycling collections are chargeable services.
