District Local Plan Policies continue in force

Under the Planning and Compulsory Purchase Act 2004, which brought in the system of Local Development Frameworks (LDF), the policies in the adopted District Local Plan were saved for a transitional period of three years from the date of the commencement of Act. This period expired on the 27th September 2007. The Act does, however, allow the Secretary of State for Communities and Local Government to extend the saving of policies beyond that date.

In March 2007, the District Council made an application to Government Office for the West Midlands (GOWM) to ‘save’ a number of policies in the Adopted District Local Plan beyond the 27th September 2007.

The District Council received a Direction from the Government Office for the West Midlands dated the 7th September 2007, under paragraph 1(3) of schedule 8 to the Planning and Compulsory Purchase Act 2004 setting out the policies which are ‘saved beyond’ the 27th September 2007.

Those policies that are saved will continue in force until replaced by new Development Plan Documents, prepared as part of the Local Development Framework.
